New York City Employers:
Further to our post from yesterday, NYC amended the Earned Safe and Sick Time Act (ESSTA), and the changes become effective on February 22, 2026. The amendment will reduce employer obligations under the City’s Temporary Scheduling Change Act (TSCA).
The TSCA previously required employers to grant employee requests for temporary changes to their work schedule for personal events twice per calendar year, for up to one business day per request. Under the ESSTA amendments, employers are no longer legally required to grant these requests.
However, employers must still respond to an employee’s request as soon as practicable and may also propose an alternative temporary change. Reach out with any questions.
