New York employers: Article 6 of the New York Labor Law, among other things, currently exempts individuals employed in a bona fide executive, administrative, or professional capacity whose earnings exceed $900 per week from certain protections under the law, including:

  1. payment “not less frequently than semi-monthly”,
  2. requiring advance, written consent for direct deposit, and
  3. the employer being guilty of a misdemeanor if it fails to provide benefits or wage supplements within 30 days after they are due.

Governor Hochul recently signed a bill available here: NY State Senate Bill 2023-S5572, which states that, effective March 13, 2024, the minimum exempt weekly salary threshold for such exemptions will increase from $900 to $1,300 per week.

Please note that the salary threshold for these protections is separate and distinct from those pertaining to overtime exemptions, which we also expect to be increasing in 2024. Stay tuned.
