NY Employers: As of Monday, November 13, 2023, the New York Labor Law will require employers to provide departing employees — newly including those who experience partial unemployment such as a temporary separation or reduction in hours — with a notice of their right to file for unemployment benefits.
The notice:
- must be provided upon any “interruption of continued employment that results in total or partial unemployment,” including a permanent or indefinite separation, a temporary separation or a reduction in hours; and
- must be provided in writing on a form approved by the NYS DOL and should include certain information, including the employer’s name, address and registration number.
It does not appear that the NYS DOL has issued a revised form notice yet. We are keeping watch. The previously existing Record of Employment form already in effect.
