Attention California employers
The California Worker Adjustment and Retraining Notification (“WARN”) Act will require new additional disclosures effective January 1, 2026.
The California WARN Act requires employers with 75 or more employees to give at least 60 days’ advance notice of a mass layoff, plant closure, or relocation of 100 or more miles. Notably, the California WARN Act has requirements greater than the Federal WARN Act, and this new rule expands the law even further.
Specifically, the new rule requires:
- employers to state in their notices whether they plan to coordinate “rapid-response” services through the local workforce development board, another entity, or none at all;
- a short description of the CalFresh food-assistance program, helpline and a link to the program’s website in each notice and
- employers to provide a functioning email address and phone number in every WARN notice so that employees or agencies can reach a company representative.
To remain compliant and avoid penalties, please consult with a D+G attorney prior to any event that triggers the California WARN Act.
