We have previously reported on the two Executive Orders “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government” and “Ending Illegal Discrimination and Restoring Merit-Based Opportunity” which require federal agencies to “remove, and cease issuing, any statements, policies, regulations, and other messages that promote or otherwise inculcate gender ideology” and to combat “illegal private-sector DEI preferences, mandates, policies, programs, and activities.”

As previously reported, various parties have sued to enjoin these executive orders in numerous forums. In July, the city of Seattle sued to stop the enforcement of these two executive orders and moved for a preliminary injunction last month.

On Tuesday, the Trump administration responded, arguing that Seattle cannot show that it faces irreparable harm because it is “mere speculation” that a federal agency may try to terminate the city’s federal grants due to noncompliance with the executive orders.

It remains to be seen how the court will rule.
