Texas employers take note: As states across the country continue to pass #metoo legislation aimed at preventing provisions in employment agreements that prohibit disclosure of sexual harassment allegations, Texas has now joined this group.
The Texas legislature has passed SB 835, a law which will invalidate provisions of employment agreements, settlement agreements or any other agreements to the extent they prohibit an individual from disclosing an act of sexual abuse or facts related to an act of sexual abuse. The law takes effect on September 1, 2025, however it explicitly provides that it has retroactive effect on agreements entered into before the effective date.
In light of this development, Texas employers should make sure to review and update their employment and separation agreements to ensure they are in compliance with the new law.
