Illinois employers: As a reminder, the state’s pay transparency law takes effect January 1, 2025.
Among other requirements, employers with 15 or more employees must include pay and benefits information in job postings for Illinois-related positions.
A job posting is subject to the law if the position will be:
- physically performed, at least in part, in Illinois or
- physically performed outside of Illinois but that reports to a supervisor, office, or other work site in Illinois.
FAQs issued by the Illinois Department of Labor (IDOL) have further clarified that non-Illinois employers are required to follow the law only for positions that could be performed in Illinois “if the employer had a reason to know or reasonably foresees at the time it made the specific job posting that the work would be done, at least in part, in Illinois, or would report to a supervisor, office, or other work site in Illinois.”
As there are many nuances to this new law and the potential for hefty penalties for non-compliance, employers are encouraged to contact legal counsel to ensure compliance with any postings which may potentially be subject to this law.
