A federal appeals court recently upheld a jury verdict in a case brought by a while male employee against his former employer in which he alleged that his race and gender were motivating factors in his employer’s decision to terminate his employment. Notably, the plaintiff relied on various DEI initiatives by his employer to support his discrimination claims.

Other key evidence included that the employee had a record of strong performance, was replaced by a woman, and that his manager had conflicting explanations for the termination decision.

The case reinforces the importance to employers of closely examining DEI initiatives to ensure they promote the important and desired goals without giving the appearance or reality of differential treatment that could lead to legal claims by candidates or employees, and to make sure managers are trained to handle termination meetings and to give feedback without the appearance or reality that protected characteristics are a factor in employment decisions.
