Now that we are settling into the new year, we remind employers that 22 states have increased their minimum wage for 2024: AL, AZ, CA, CO, CT, DE, HI, IL, ME, MD, MI, MN, MO, MT, NE, NJ, NY, OH, RI, SD, VT, WA.

Additionally, if you have employees in New York, California, or Washington, make sure you are up to speed with 2024’s increases to salary thresholds for overtime exemption that went into effect on January 1, 2024.

New York: The exemption salary threshold in New York City, Nassau, Suffolk and Westchester is now $1,200.00 per week ($62,400 annually).

California: Under California law, the overtime exemption salary threshold is two-times the minimum wage. This year, California’s minimum wage increased to $16 per hour, and accordingly, the overtime exemption salary threshold for California employees increased to $66,560 annually.

Washington: Washington’s exemption salary threshold for 2024 increased to $1,302.40 per week ($67,724.80 annually).

Employers should note that the exemption salary threshold is not the only factor that determines whether an employee is exempt from overtime. Employers should consult with counsel to make sure all other applicable factors are considered when determining exemption status for employees.
