New York employers have been waiting anxiously to see whether Governor Hochul will sign into law the proposed noncompete ban. Bloomberg is reporting that the Governor is calling for some modifications to the proposed law, which would take effect 30 days after she signs it.

The Governor stated late last week:

“What I’m looking at right now is striking the right balance between protecting low and middle-income workers, giving them flexibility to have mobility to go from job to job as they continue up the ladder of success . . . . But those who are successful have a lot more negotiation power, and they’re at the industries that are an important part of our economy here in New York.”

Reports suggest that the Governor is considering a change to the proposed law that would permit noncompete provisions to be enforced against high wage earners who make a [to be determined] floor of salary per year. Members of the business community have suggested that number may be $250,000.
