Two U.S. Senators have proposed federal legislation, the “No Robot Bosses Act of 2023,” that would regulate the use of artificial intelligence in employment decisions on a national level. While the text of the proposed legislation is not yet available, the two senators sponsoring the bill have released a fact sheet summarizing the law’s protections if enacted.
Such protections including prohibiting employers from relying exclusively on automated decision systems when making employment-related decisions, requiring independent human oversight before using the outputs generated by an automated decision system, and requiring pre-deployment and periodic testing of such automated decision systems to prevent unlawful biases.
The fact sheet does not define the terms “automated decision system” or “employment-related decision” but the examples cited in the fact sheet suggest that the law would be much more expansive than New York City’s AI bias audit law, which the city began enforcing on July 5, 2023.
