Do you have employees in San Francisco? If you do, you may be subject to the San Francisco Health Care Security Ordinance (HCSO) – and you must take action by May 1.
The law applies if you have 20 or more employees (including employees working outside of San Francisco).
By May 1, 2023, you must complete the 2022 annual reporting form. This form summarizes how you complied with the law, including tracking the number of covered employees and health care expenditures made on their behalf.
By May 1, 2023, you also must satisfy your 2023 Q1 Health Care expenditures.
Specifically, employers with (i) fully insured plans or (ii) employees who waived the employer’s self-insured health plan coverage, must calculate and satisfy their 2023 Q1 health care expenditures by this date.
Lastly, a reminder that the health care expenditure increased to $3.40 per hour (from $3.30) for large employers and $2.27 per hour (from $2.20) for small employers.
Examples of health care expenditures include:
- Payments for health, dental, and/or vision insurance for employees and their spouses and dependents
- Payments to the SF City Option on behalf of employees
- Contributions to HSAs
